Website only; no consulting engagement

The site provides general information about Fairbank Ventures and its services. Using the site, sending an inquiry, or receiving a response does not create a client, advisory, fiduciary, employment, partnership, or other professional relationship. Any consulting or other services will be governed by a separate written agreement signed by the applicable parties. If that agreement conflicts with these Terms, it governs the services covered by it.

Permitted use

We grant you a limited, revocable, non-exclusive, non-transferable licence to access and use the site for lawful, personal or internal business purposes in accordance with these Terms. You must not:

• use the site in violation of applicable law or another person’s rights;
• interfere with the site, bypass security measures, introduce malicious code, or attempt unauthorized access;
• scrape, crawl, or use automated means to access the site in a way that imposes an unreasonable load or circumvents access controls;
• impersonate another person or submit information that is false, unlawful, infringing, or harmful; or
• reproduce, republish, sell, or commercially exploit site content except with our prior written permission or as permitted by law.

Intellectual property

The site and its content, including text, graphics, logos, videos, images, software, and design, are owned by or licensed to Fairbank Ventures Inc.and are protected by Canadian and other applicable intellectual property laws. Fairbank Ventures names, logos, and related marks may not be used without prior written permission. Nothing in these Terms transfers ownership of the site or its content to you. Rights not expressly granted are reserved.

Inquiries and submitted content

You retain ownership of information you submit through the contact form. You authorize us and our service providers to use, reproduce, and transmit that information only as reasonably necessary to process and respond to your inquiry, evaluate a potential engagement, operate and secure the site, and comply with law.

Do not submit confidential information, trade secrets, or personal information about another person unless you are authorized to do so. A submission is not treated as confidential unless we have agreed otherwise in writing. Our handling of personal information is described in our Privacy Policy.

No professional advice

Site content is provided for general informational purposes only. It is not professional, legal, tax, accounting, investment, or financial advice and should not be relied on as a substitute for advice tailored to your circumstances. Results, examples, or observations described on the site do not guarantee future results.

These Terms do not apply to liability arising under a separate signed services agreement, which is governed by that agreement.

Ontario consumer rights

If you are a consumer in Ontario, the Consumer Protection Act, 2002 and other laws may provide rights and remedies that cannot be waived. Nothing in these Terms is intended to waive or restrict those rights or remedies. The website does not itself offer online checkout or form a contract for paid consulting services.

Governing law

These Terms and your use of the site are governed by the laws of the Province of Ontario and the federal laws of Canada applicable there, without regard to conflict-of-law rules. Subject to any rights you may have under applicable consumer-protection law, you and Fairbank Ventures submit to the exclusive jurisdiction of the courts located in Ontario for disputes relating to these Terms or the site.

Changes to these Terms

We may update these Terms from time to time. The revised Terms take effect when posted, unless a later date is stated. The updated date appears above. Your continued use of the site after the revised Terms take effect means you accept them. Changes to a separate services agreement must be made in accordance with that agreement.

General

If any provision of these Terms is found unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will continue in effect. Our failure to enforce a provision is not a waiver. These Terms are the entire agreement between you and us regarding use of this public website, but do not replace any separate written agreement for services.
